1. Acceptance of Terms

These Tutor Terms are part of the Tutorela.com Terms of Service and Privacy Policy a contract between Tutorela (or "us", "we', the "Company") and you (or the "Tutor") and describe our business relationship with you and how we will work together with respect to the Services, including the nature and limitations of the Services we agree to provide to you, including your permitted use of our Website. Capitalized terms not defined hereunder shall have the meaning given to them in the Terms of Service.

2. The Services

  1. Under the Services we provide an online platform consisting of an index and an online guide of private tutors providing lessons to clients (“Students”) in various subjects, including an option to find information about tutors from different locations and specializing in different fields (“Platform”).
  2. We allow each tutor to have a personal webpage without paying any additional fees, while students may easily search for tutors (“Website”).

3. Account Registration and Usage

  1. To use the Website or the Platform as a Tutor you will need to register on the Website and create an account.
  2. In order to register on the Website and open an account, you will be required to the following: (i) provide accurate and complete information; (ii) promptly update your account information with any new information that may affect the operation of your account; (iii) authorize Tutorela to make any inquiries we consider necessary or appropriate to verify your account information or the information you provide to us related to any Services you provide via the Platform; and (iv) accept the Terms of Service and Privacy Policy.
  3. You are responsible for safeguarding and maintaining the confidentiality of your account information. You agree not to disclose your account information to any third party and that you are entirely and solely responsible for any and all activities or actions that occur pursuant to the use of your account on the Platform, whether or not you have authorized such activities or actions. You will immediately notify Tutorela of any unauthorized use of your account.
  4. You agree that you will not permit, enable, introduce or facilitate other persons to participate in providing tutoring services from your account, including others who may be subject to an agreement that is the same or similar to this Agreement.
  5. We may, in our sole discretion, perform background checks or may require you to provide some additional information to identify you.
  6. By applying to become a Tutor you are re-affirming acceptance of these Terms.

4. Code of Conduct and Covenants

  1. You will not use the Website to inquire about, engage in or aid or assist anyone with any form of academic dishonesty (for example, completing assignments or projects, writing papers or essays, taking (or help take) quizzes or examinations on someone’s behalf, or completing work in violation of academic policies or other conduct policies of a school, university, academic institution or workplace.
  2. You are entirely responsible for all content that you create, upload, post, send, receive or store through your use of the Website or offline, directly to the Student (“Content”).
  3. Tutors shall not create, upload, post, send, receive or store Content that: (a) is inaccurate, harmful, obscene, pornographic, defamatory, racist, violent, offensive, harassing, inconsistent with the Tutorela mission or otherwise objectionable to Tutorela or other Users; (b) includes unauthorized disclosure of personal information; (c) violates or infringes anyone’s intellectual property rights; or (d) contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment.
  4. Tutorela reserves the right to edit or remove Content that: (i) violates these Terms, (ii) that contains third-party commercial advertisements, or (iii) for any other reason it deems necessary under applicable law or for public benefit.

5. Fees and Payment

  1. You agree that the classes and the relationship between you and the Student constitute an independent contract between you and the Student, that is not related to the Website Services or to the Platform. All payments that will be agreed between you and the Student will be made independently.
  2. You agree to pay a fee to Tutorela in exchange for use of the platform.
  3. You hereby clarify that Tutorela is not responsible for any payments made in connection with the lessons given by you to the Student and will not have any responsibility in this regard and the Tutor hereby waives in absolute discretion any claim in this matter.

6. Booking a Class

  1. When a Student has completed registration of its profile, he/she may submit a request for joining a lesson with You.
  2. The price charged for a class includes the Fee payable to You, Tutorela tutoring’s fee for provision of the Website and any applicable VAT.
  3. It is the Tutor’s sole responsibility to provide the Student with an Invoice for the payment.
  4. If You wish to discontinue any class or series of classes with a Student, You must contact Tutorela. In such circumstances, we may in our sole and absolute discretion refund the Student for any unused class or allocate the Student to another Tutor.

7. Cancellations, Postponements and Refunds

  1. If a Student wishes to cancel or postpone a class with You, he must notify You no less than 24 hours prior to the allotted appointment time. If less than 24 hours’ notice is given, the Student will be charged the full amount for the Session.
  2. If You wish to cancel or postpone a class, You must notify the Student no less than 24 hours prior to the allotted appointment time. If less than 24 hours’ notice is given, You will be required to provide the postponed class for free as soon as practicable, at the Student’s convenience.
  3. If a scheduled class cannot take place due to a failure on the Website or due to other matter for which the responsibility is of Tutorela, the Tutor and the Student may agree to postpone the Session and undertake the relevant Session at a mutually convenient time.

8. Intellectual Property and Copyright

  1. Tutorela respects the intellectual property of others, and we ask our Tutors to do the same. Accordingly, Tutors may not post, modify, distribute, or reproduce in any way any Content on the Website that is copyrighted material you do not own or have permission to use, without obtaining prior written consent of the copyright owner.
  2. Tutorela reserves the right, in its discretion, to remove any Content if we believe it may infringe the copyright rights of others, and/or to terminate the accounts of Users who we believe to be infringers.
  3. If you believe that your work has been copied and posted on the Site in a way that constitutes copyright infringement, we will respond to notices of alleged infringement in accordance with the governing laws.
